Terms of Service

These Terms govern your use of Chalk, operated by Thinkerbell Labs Pvt. Ltd. By creating an account or signing in you agree to them.

1. The service

Chalk lets you create and edit braille notes on the web, sync them with a paired Tactera device, organise them into folders, and (optionally) import or export files from Google Drive.

2. Eligibility

You must be at least 16 years old to create a Chalk account. If you are using Chalk on behalf of an organisation you confirm that you have authority to bind that organisation to these Terms.

3. Your account

  • You are responsible for keeping your sign-in credentials secure, including access to the email inbox used for one-time codes and magic links, and your Google account if you use Google sign-in.
  • You must give us accurate registration information and tell us if it changes.
  • You may not share your account, and you may not create accounts using automated means.

4. Your content

You retain ownership of the notes, folders, and files you upload to Chalk. You grant Thinkerbell Labs a limited licence to host, process, and transmit that content for the sole purpose of operating the service for you (for example, storing your notes in our database and syncing them to your paired Tactera).

You are responsible for ensuring that you have the right to upload, sync, or export any file you import into Chalk. Do not upload content that infringes third-party intellectual-property rights or violates applicable law.

5. Acceptable use

You agree not to:

  • Reverse-engineer, decompile, or otherwise attempt to extract source code or credentials from Chalk, the Tactera device firmware, or the device-to-server API.
  • Probe, scan, or test the vulnerability of our systems without prior written permission. Coordinated security disclosures are welcome at contactus@thinkerbelllabs.com.
  • Use Chalk to store or transmit malware, illegal content, or spam.
  • Impersonate other users or misrepresent your affiliation.
  • Use the service in violation of export-control laws or sanctions regimes that apply to you or to Thinkerbell Labs.

6. Google Drive integration

If you connect Google Drive, you grant Chalk permission under the Google drive.filescope to access files Chalk created on your Drive and files you explicitly select through the in-app picker (.txt, .brf, .epub), and to write notes you choose to export. Chalk does not request access to your entire Drive library. Your use of Google Drive is also governed by Google's own terms; we are not responsible for Google's service.

7. Beta features

Some features may be marked as beta, preview, or experimental. They are provided without any warranty and may change, break, or be removed without notice.

8. Suspension and termination

  • You can delete your account at any time from /settings. Deletion is permanent and removes your notes, folders, library metadata, device pairings, and Drive token.
  • We may suspend or terminate your account if you materially breach these Terms, if your use poses a security or legal risk to Chalk or other users, or if we are required to do so by law. We will give you reasonable notice unless that would compromise an investigation.

9. Disclaimer

Chalk is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, Thinkerbell Labs disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components, or that any data loss will not occur. Keep your own backups.

10. Limitation of liability

To the maximum extent permitted by applicable law, Thinkerbell Labs's total cumulative liability for any claim arising out of or related to the service is limited to the greater of (a) the amounts you have paid Thinkerbell Labs for Chalk in the twelve months preceding the claim, and (b) INR 5,000. We are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits or data.

Nothing in these Terms limits liability that cannot be limited under applicable law (for example, liability for death or personal injury caused by negligence, for fraud, or for breach of statutory consumer rights).

11. Indemnity

You agree to indemnify and hold harmless Thinkerbell Labs from claims, damages, and reasonable expenses arising from (a) your breach of these Terms, (b) your violation of any law or third-party right, or (c) content you upload to Chalk.

12. Changes

We may update these Terms from time to time. Material changes are notified by email and require fresh acceptance at next sign-in. Continued use of Chalk after a change means you accept the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of India. The courts of Bengaluru, Karnataka have exclusive jurisdiction over any dispute, except where mandatory consumer-protection law in your country of residence grants you the right to bring proceedings in your local courts.
